Abstract:
La presente investigación de tesis tiene como objetivo demostrar la capacidad económica del deudor, según los criterios para poder determinar la pensión de alimentos que se tiene con los niños y adolescentes, tal como lo establece el artículo 481° del Código Civil, donde limita la correcta aplicación del principio como interés superior del niño y adolescente. El interés superior de los niños y los adolescentes estipula que todas las medidas que son adoptadas por los administradores judiciales, en las que se vea involucrado un menor de edad, estos deben ser el principal interés superior de este, sin embargo, es frecuentemente observar sentencias que establecen pensiones alimenticias desproporcionados a las necesidades del menor, imposibilitando que la acción procesal de petición y asegure lo necesario para la satisfacción de necesidades esenciales del menor y el adolescente donde permita su óptimo desarrollo en la sociedad. La opinión defendida es que la capacidad económica del deudor alimentario no debe ser un obstáculo para que el menor logre su máximo desarrollo, se deben tomar medidas que no vulneren la correcta aplicación del principio en aras del interés superior de los niños, niñas y adolescentes. La tesis utiliza un método de investigación de nivel descriptivo, con un diseño de tipo experimental, ya que solo se analiza el fenómeno a través de las opiniones expresadas por los sujetos de investigación y abogados especialistas en derecho civil y/o familia, que hayan tenido procesos en materia de asignación alimenticia en el año 2019.
